Beginner Membership – Terms & Conditions

These Beginner Membership Terms & Conditions (“Beginner Terms”) govern the access and use of the Beginner Tier membership within the EXP.JOURNEYS network operated by EXP. and its affiliates (“EXP.”, “we”, “us”).

By creating an account, accessing the network, or using Beginner Tier features, members agree to these Beginner Terms in addition to EXP.’s general Terms & Conditions, the XP Membership Points Terms & Conditions (“XP Terms”), and the Privacy Policy.

1. Nature of Membership

The Beginner Membership is a complimentary, non-proprietary entry-level subscription tier. It provides the foundational access required to participate in the EXP.JOURNEYS ecosystem without the requirement of an annual subscription fee.

• Membership does not constitute an interest in property, a security, or a guaranteed right to any specific service.
• Access to the EXP.JOURNEYS network under this tier is a revocable privilege and may be modified or terminated by EXP. at any time.

2. Fees and Subscription

• No Membership Fee: The Beginner Tier is free of charge. No annual fee or subscription payment is required to maintain this status.
• Status Duration: The membership remains active until the member upgrades to a paid tier (e.g., Explorer Tier), voluntarily closes their account, or the account is terminated by EXP. in accordance with Section 5.

3. Beginner Tier Benefits: XP Accrual

Subject to these Beginner Terms, the primary benefit of the Beginner Tier is the eligibility to earn and accumulate XP (Membership Points).

• XP Earning: Members may earn XP on eligible bookings, rides, and missions within the EXP.JOURNEYS network, subject to the specific issuance rates defined in the XP Terms.

4. Modification of Terms and Benefits

EXP. reserves the right, at its sole discretion and at any time, to:

• Modify the rate at which XP is issued to Beginner Tier members.
• Change, suspend, or withdraw the XP accrual feature for the Beginner Tier.
• Introduce new requirements or limitations for maintaining a Beginner Tier account.
• Update these Beginner Terms with reasonable notice. Continued use of the membership after such modifications take effect constitutes binding acceptance of the revised Terms.

5. Termination and Inactivity

• Account Integrity: EXP. may terminate a Beginner Membership immediately if it determines, in its sole discretion, that a member has engaged in fraud, multiple account creation to manipulate rewards, or any misuse of the XP system.
• Inactivity: EXP. reserves the right to deactivate or close Beginner Tier accounts that show no activity (defined as logins or XP accrual) for a continuous period of twenty-four (24) months.
• Effect of Termination: Upon termination or account closure, all accumulated XP shall be immediately forfeited as governed by Section 5 of the XP Terms.

6. Limitation of Liability

To the maximum extent permitted by law, EXP. shall not be liable for:

• Any loss or disappointment resulting from the inability to earn XP due to technical errors or service unavailability.
• The expiration, removal, or calculation errors of XP points.
• Any loss resulting from the modification or termination of the Beginner Tier program.

In the event of a claim related to the Beginner Membership, EXP.’s total liability shall not exceed HKD 100.

7. Governing Law

These Beginner Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.
