Explorer Membership – Terms & Conditions

These Explorer Membership Terms & Conditions (“Explorer Terms”) govern the subscription, access, and use of the Explorer Tier membership within the EXP.JOURNEYS network operated by EXP. and its affiliates (“EXP.”, “we”, “us”).

By subscribing to or using Explorer Tier benefits, members agree to these Explorer Terms in addition to EXP.’s general Terms & Conditions, the XP Membership Points Terms & Conditions (“XP Terms”), and the Privacy Policy.

1. Nature of Membership

The Explorer Membership is a paid, non-proprietary subscription tier. It grants a revocable, limited right to access specific discounts for stays, rides, and play games within the EXP.JOURNEYS network.

1. Membership does not constitute an interest in property, a security, or a guaranteed right to any specific service.
2. Benefits are subject to availability and the specific House Rules of individual locations or service providers.

2. Fees and Subscription

1. Annual Fee: The Explorer Membership requires a non-refundable annual payment of HKD 360 (or currency in an amount of equivalent value at the time of exchange) (the “Membership Fee”).
2. Billing and Auto-Renewal: The Membership Fee is billed annually in advance. Subscriptions will automatically renew on the anniversary of the Effective Date unless cancelled in accordance with these terms and conditions.
3. Cancellation of Subscription: To prevent automatic renewal, members must provide notice of cancellation before the anniversary of the Effective Date.
4. No Refunds: All Membership Fees are final. No partial or full refunds will be issued upon voluntary cancellation or termination of membership.

3. Explorer Tier Benefits

Subject to these Explorer Terms, members are eligible for:

1. Network Discount: A 5% discount on the applicable base rate of eligible bookings and experiences within the EXP.JOURNEYS network.
2. Priority Access: Priority windows for booking stays.
3. Joining Bonus: First time Explorer members will receive a one-time gift of 50 XPs. This gift may only be received once per account.

5. Modification of Terms and Benefits

EXP. reserves the right, at its sole discretion and at any time, to:

1. Modify Membership Fees, discount rates, or XP issuance rates.
2. Change, suspend, or withdraw any benefit or feature of the Explorer Tier.
3. Update these Explorer Terms with reasonable notice to members. Continued use of the membership after such modifications take effect constitutes binding acceptance of the revised Terms.

6. Termination and Forfeiture

1. Account Integrity: EXP. may terminate an Explorer Membership immediately if it determines, in its sole discretion, that a member has engaged in fraud, misuse of the 5% discount, or manipulation of the XP compensation system.
2. Effect of Termination: Upon termination or expiration of the Explorer Tier, all tier-specific benefits (including the 5% discount and 48-hour flexibility) shall immediately cease.
3. XP Forfeiture: Forfeiture of accumulated XP upon termination is governed by Section 5 of the XP Terms.

7. Limitation of Liability

To the maximum extent permitted by law, EXP. shall not be liable for:

1. Any loss, damage, or disappointment resulting from the unavailability of any Base, Ride, or Mission.
2. The expiration or removal of XP compensation issued following a cancellation.
3. Any errors in the display or calculation of member discounts.EXP.’s total liability for any claim related to the Explorer Membership shall not exceed the amount of the most recent Annual Fee paid by the member.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.
