Terms & Conditions for Dreeem-Lab.hkg.KHS

General

These Terms & Conditions govern the User's access and use of the co-creation space service at DREEEM-Lab.hkg.khs, located on the 7/F, 25/F, 26/F and 27/F of 1 Kin Hong St., Kwai Chung, Hong Kong (hereinafter called "the Service") managed by Creative Express Ltd., a registered company in the Hong Kong Special Administrative Region of the People's Republic of China, and its affiliated companies (hereinafter collectively called "EXP.").  EXP. shall provide the Service to the User on the listed terms and conditions. Reservation of the service made by usage of this website is made on the condition that the User accepts all the terms and conditions without variation. The terms and conditions may be amended from time to time at EXP.'s sole discretion with or without notice or liability to the User. It is the User's responsibility to check this page prior to the Service. By continuing to use the Services following such amendments to these Terms and Conditions, the User agrees to be bound by such amendments.

The User also understands that:

  1. While EXP. provides a space for co-creation for each individual, the facilities are shared with other users unless otherwise indicated in the space.
  2. All common areas are subject to temporary exclusive rentals during which period community access will be restricted unless otherwise permitted by the temporary renting party.
  3. Due to the nature of the location, EXP. is unable to provide the accessibility to all locations fit for persons with physical disabilities.
  4. No smoking and disturbing other users are allowed during the use of the Service. Eating is only allowed in designated areas.
  5. Users are responsible for their personal belongings and will not seek compensation from the Service for any damage or misplaced items.


Terminology

The following definitions apply in these terms and conditions:

User: any natural person who has gained permission to access this space

The website: official website of EXP. / exp.is and all associated sub-domains.

The User: anyone, over 16 years old, who uses the Service provided by EXP. through reservation made and confirmed on this website, social media channels, other online travel agency platforms or direct booking through other means.

Monthly Membership Dues: The monthly fee is indicated on your membership contract. Payment is due on the first day of each month and is late if received after the 5th of the month (10% late fee applied on the 6th).

Member Rights in the Premises: Member(s) may share all of the common spaces (e.g., member lounge, hallways, and restrooms.) in the Premises equally with the other members. Members cannot sublease space nor resell any services already offered and sold by Mesh Cowork, LLC. This includes, and is not limited to, sharing, gifting, or reselling meeting room hours.

Guests: A guest is defined as a person or persons that are visiting a member for a period not to exceed one workweek.

Reservation and Confirmation of Reservation of Service

When making a reservation of service, the User must give particulars including:

  1. Legal name and valid contact detail of the User
  2. Date, Time and duration of use
  3. Intended check-in and check-out time in the case of short-term reservation,
  4. or specific event, in the case of event reservation.
  5. Any other information required by EXP.
  6. The User will receive a confirmation email upon manual/automated confirmation after successful reservation requests.

Monthly Membership

A User becomes a member after completing the membership agreement with one of our staff members on an official membership contract, which indicates a monthly membership of no less than 3 months.

Monthly members can access the space via pre-authorised digital keys.

The monthly membership fee will be charged automatically on the credit card held by our payment gateway provider Stripe. A failed payment will be invalid and if no rectification is taken in time as defined under Monthly Membership Dues, a late fee will incur.

Payment Methods and Currency

Users can pay the full amount by various credit cards, using HKD currency, through our online payment platform (Stripe) at the time of making a reservation/subscribing to a membership. EXP. does not store any credit card information and all payments are handled via the 3rd party company Stripe.

A deposit equivalent of HKD 500 may be assumed as User checks in. This amount will not be processed by EXP. unless such an event occurs to deem necessary, including but not limited to damage and unauthorised appropriation of property, for EXP. to recover its losses. EXP. reserves the right to execute this charge onto the credit card used to make for the reservation, or demand the payment directly from the User if necessary.

Registration

The User may choose to register the following particulars electronically before arrival at the Service, or upon arrival: Name, age, gender and other particulars deemed necessary by EXP. Local Official ID or passport would be required to be presented for identification upon arrival for the first time.

Business Hours & Hours of Stay

Please refer to the confirmation email for your time of check-in and check-out. Early check-in and late check-out is possible at EXP.'s discretion upon request via email.

For an hourly stay, the user should be making the minimum hour plan sufficient to cover the full intended period of stay, including use of all facilities within the Location.

Extension of stay is subject to availability of space at the time of request. All extensions will be charged at the hourly rate of HKD 99, with a maximum extension of 4 hours.

EXP. provides staff support through phone 24 hours a day, and does not guarantee staff to be physically available on site.

Amendment and Cancellation of Reservation

Details of reservation can be amended by notifying our eXperience Officer (XO) via email at xo.hkg@exp.is. The amendments must be requested at least 48 hours before the scheduled check-in time. Otherwise, such requests may not be catered. For an hourly stay, due to the short preparation time nature, amendments will be honored on a case by case basis at EXP.'s sole discretion.

By making a night booking with us, the User accepts and agrees to the following cancellation policy:
         a.) 100% refund when canceled 14 days ahead of arrival date.
         b.) 50% refund when cancelled 2 -14 days ahead of arrival date.
         c.) No refund for no show / cancellations made less than 48 hours before the arrival.

When a refund is issued, the actual process will be handled by our payment company Stripe, which states that a refund usually takes 5 to 12 working days.

If the User, without giving proper notice, fails to arrive at the scheduled arrival time, EXP. may treat the reservation as being cancelled by the User.

For an hourly stay, users may cancel at any time before the scheduled check-in time.

EXP. reserves the right to cancel any reservation/accommodation upon finding that:

  1. The User is found to be infected with an infectious disease
  2. The User in question has used the accommodation for gambling or other illegal purposes, or otherwise to violate public morals
  3. The User in question is extremely intoxicated
  4. The User has caused significant disturbance to other users
  5. The User fails to observe our house rules (e.g. no smoking, eating and making loud noises) within our premise
  6. The User brings along other individuals that does not have a confirmed reservation for that time period into the premise, without approval from EXP.

EXP. is unable to continue to accommodate the User in question due to disaster, failure of facilities or other unavoidable reason.

Handling of Goods Deposited / Storage of LUGGAGE or Belongings of the User

Personal belongings of the User should be stored in lockers provided. Luggage size is recommended to be within 65 cm x 45 cm x 30 cm (Medium size). The User is responsible for the safety of the belongings. The User must carefully retain the password for the locker and keep it private. If any luggage or personal belonging were left behind, EXP. will store the luggage for 14 days including the day the luggage was found, but thereafter EXP. reserves the absolute right and discretion to either continue storing the luggage (luggage storage charges shall continue to apply and the User shall be liable for such charges) or to dispose of the luggage or item without any liability to you.

EXP. will not be responsible for loss of or damage to the Personal belongings, the contents therein or your personal belongings (including any valuables, even if we have been advised) during storage or during the disposal process however caused and the User hereby releases EXP. from any liability in respect thereof.

Direct Marketing

We would love our users to be among the first to receive the latest information and offers about EXP. products and services. When we contact you it may be by email, WhatsApp/text messages or social media messages. You can unsubscribe from communications at any time by clicking the "Unsubscribe" link in any promotional or marketing communication received from us or by contacting us via email at xo.hkg@exp.is with the subject "unsubscribe". Your privacy is important to us and we will only use your personal information for direct marketing/communication purposes in accordance with all applicable laws.

Liability

Each User fully indemnifies EXP, its affiliates, and the directors, officers or employees of each, against all actions, losses, claims, damages, costs and expenses of whatever nature arising directly or indirectly from any breach of any representation or warranty or any Terms or Conditions contained herein.

To the maximum extent permitted by applicable law, EXP shall not be liable to any person for any loss or damage (whether caused by the negligence of EXP or otherwise) or any personal injury or death arising (whether directly or indirectly) from or in connection with the use of the Service.

Liability of User

The User shall compensate EXP. for any damage to the premise and property of EXP.,  caused by an act or negligence on the part of the User during the stay.

Jurisdiction

All problems arising from this contract shall be resolved in accordance with the law of the Hong Kong Special Administrative Region at court with jurisdiction in the area in which the Service is located.
