GENERAL TERMS AND CONDITIONS
These general terms and conditions (“Terms and Conditions”) apply to all hotel, lodging, and private hire properties in EXP., including SLEEEP Myoko, SLEEEP Fuji, SLEEEP Soho, SLEEEP central, EXP._Co-Onsen, EXP._Atelier (each, a “Property”). These Terms and Conditions govern your stay at the Property—whether for individual room or capsule accommodation or entire private property hire—as well as the use of facilities and related services rendered by the Property to guests. The Property may however request the guest to sign a separate disclaimer form, hire agreement, or other declaration for specific services, activities, or exclusive use arrangements. Nothing in these Terms and Conditions shall serve to restrict any rights and remedies a Property may be entitled to, whether by law or equity.
1. Definitions
“Property”, “we” or “our” means the specific hotel or private hire estate you are visiting and/or staying at.“Guest”, “you” or “your” means the person or persons visiting and/or staying at the Property.“Facilities” means the guest kitchens; shared or private bathing areas, saunas and onsens; lockers; laundry areas; co-working spaces; gardens and equipment for hire provided by the Property.
2. Accommodation and Private Property Hire
(a) Right of Entry: We reserve our right to enter the Property (including guest rooms, capsules or private hire areas) for any purpose, and in particular for the safety and security of guests, maintenance, and the protection of our property.
(b) Valuables: The Property does not provide safety deposit boxes. Guests are solely responsible for the safety and security of their money, jewels, or other valuables stored in lockers. The Property assumes no responsibility for any loss or damage to personal property left at the Property or in lockers.
(C) Private Property Hire:i. Responsibility and Capacity: For properties hired in their entirety, the Guest (the "Lead Booker") assumes full responsibility for the conduct and actions of all members of their party. Total occupancy must not exceed the maximum capacity specified at the time of booking.
ii. Capsule Accommodations: For properties featuring capsule-style accommodations, occupancy is strictly limited to one (1) individual per single-occupancy capsule. The sharing of a single-occupancy capsule by more than one guest is expressly prohibited regardless of age or circumstances.
iii. Supplemental Charges (EXP._Co-Onsen): At EXP._Co-Onsen, the base reservation rate covers a maximum of four (4) guests. For each additional guest exceeding this base occupancy, a supplemental Linen Charge of ¥5,000 per person shall be applied, up to a maximum aggregate cap of ¥20,000 per reservation.
iv. Enforcement and Unauthorised Use: If the number of occupants is found to exceed the number declared at the time of booking, EXP._Co-Onsen reserves the right to assess additional charges in accordance with these policies or terminate the stay without refund. Furthermore, unauthorised events or commercial filming are strictly prohibited on the premises without prior confirmed bookings with the management.
(d) Payment: If your company or agent fails to settle any payment within the specified period or within a reasonable period, you will be personally (and you and your company or agent will be jointly and severally) liable for the payment of your account.
(e) Check-Out: Properties may offer check-outs via digital means or other contactless methods. Where a Guest wishes to take advantage of these methods, the Guest agrees for the Guest’s credit card or other means of payment on the Property’s file to be charged for all expenses incurred during the stay.
3. Food, Beverage, and Kitchen Use
(a) Kitchen Use & Co-Cooking: Where the Property provides a kitchen for guest use (including within private hires), Guests are responsible for maintaining hygiene and safety standards during and after usage. During "co-cooking" events involving staff and guests, participation is voluntary. Guests agree to follow all safety instructions provided by staff.
(b) Private Chef Hire:
i. Third-Party Food Deliveries (EXP._Co-Onsen & Atelier): At EXP._Co-Onsen and Atelier, the Property may facilitate food delivery services via third-party vendors. The Property acts solely as a facilitator; all food products are prepared and delivered by independent entities. The Property assumes no liability for delivery delays, food quality, or accuracy of orders.
ii. Private Chef Services: At EXP._Co-Onsen and Atelier, Guests may purchase a private chef service as a supplemental add-on to their lodging. While the Property manages the booking and coordination of this service, the chef operates as an independent professional. The Property assumes no liability for the specific culinary output or professional conduct of the chef during the engagement.
iii. Concierge Liaison and Allergy Communication: As part of our concierge service, the Property will act as a liaison to bridge language gaps and communicate Guest preferences, dietary requirements, and allergies to the private chef or delivery vendor.
Important Note on Allergies: While the Property will exercise due care in conveying all provided information to the service provider, the Guest acknowledges that the Property does not prepare the food. The Guest must confirm all dietary restrictions directly with the chef upon arrival. The Property shall not be held liable for any allergic reactions, food-borne illnesses, or the failure of the third-party provider to adhere to communicated restrictions.
(c) Food Safety: Guests assume all risks related to food they prepare themselves or consume during co-cooking events. The Property is not liable for injury arising from self-procured or self-prepared food.
4. Shared and Private Bathing, Onsen, and Sauna
(a) Facilities: Certain Properties offer shared or private bathing facilities, saunas, or onsen. Guests are expected to follow local etiquette and hygiene protocols.
(b) Health and Safety: In using these facilities, Guests are responsible for determining their own physical fitness and heat tolerance. Use of these facilities is at the Guest's own risk. Any Guest feeling unwell must exit the facility immediately.
5. Sports Activity and Equipment Hire
(a) Equipment Hire: Where the Property offers ski, snowboard, or e-bike hire, Guests are responsible for inspecting the equipment before use. The Guest is liable for any damage to or loss of the hired equipment. For e-bike hire, Guests must follow all local traffic laws and safety guidelines provided at the time of hire.
(b) Inherent Risks: Guests acknowledge the inherent risks associated with skiing, snowboarding, cycling, and other physical activities. These may result in serious injury.
(c) Guest Responsibility: Guests are responsible for disclosing relevant health history if participating in guided activities and must promptly stop any activity if pain or symptoms arise.
6. Promotional Considerations
(a) Any photography, filming or any use of or reference to any of our premises (including any part thereof) or brand name, including without limitation the name or logo of the Property or EXP., for any commercial, promotional or advertising purposes is strictly subject to our prior review and approval.
7. Governing Law
(a) These Terms and Conditions shall be governed by and construed in accordance with the applicable laws and regulations of the jurisdiction of the Property. If there is any conflict or discrepancy between the English text and any translation, the English text shall prevail.
(b) Any matter not provided for herein shall be in accordance with the Property’s specific terms and conditions, the applicable laws and regulations and/or generally accepted practices.
